DMCA Copyright Policy

1. About this policy

Miami App Studio respects the intellectual property rights of others and expects users and clients to do the same. We respond to notices of alleged copyright infringement that comply with the Digital Millennium Copyright Act (DMCA) and other applicable laws.

2. How to submit a DMCA takedown notice

If you believe content on a site or app we operate or host infringes your copyright, send a written notice to our designated agent (below) that includes:

  1. Your physical or electronic signature.
  2. Identification of the copyrighted work claimed to be infringed.
  3. Identification of the material that is allegedly infringing, with information sufficient to locate it (such as a URL).
  4. Your contact information — name, address, telephone, and email.
  5. A statement that you have a good-faith belief the use is not authorized by the copyright owner, its agent, or the law.
  6. A statement, under penalty of perjury, that the information in the notice is accurate and that you are the owner or authorized to act on behalf of the owner.

4. What happens after we receive a notice

If a notice is valid, we will remove or disable access to the allegedly infringing material and notify the user or client who posted it. We may also suspend the account of repeat infringers.

5. How to submit a counter-notice

If you believe your material was removed by mistake or misidentification, you may submit a counter-notice that includes:

  1. Your physical or electronic signature.
  2. Identification of the material removed and its location before removal.
  3. A statement, under penalty of perjury, that you have a good-faith belief the material was removed by mistake or misidentification.
  4. Your name, address, telephone, and a statement consenting to the jurisdiction of the federal court in Miami-Dade County, Florida.

6. What happens after a counter-notice

We will forward the counter-notice to the original complainant. If they do not file a court action against you within 10 business days, we may restore the material.

7. Repeat infringer policy

We may terminate, in appropriate circumstances, the accounts of users or clients who are repeat infringers.

8. Misrepresentations

Under section 512(f) of the DMCA, anyone who knowingly materially misrepresents that material is infringing — or was removed by mistake — may be liable for damages. Do not file false claims.
